Preparing evidence for the Well-led key question

Well-led evidence should show how leaders understand the service, respond to concerns and improve people's experiences. Keep the current framework separate from draft sector proposals.

A practical starting point

Three things to put in place.

  • Current organisational responsibilities and delegated authority.
  • Governance minutes showing challenge, escalation and decisions.
  • Risk and action registers connected to actual outcomes.

Current assessment approach

As reviewed on 1 November 2026, CQC's published provider guidance continues to use five key questions and quality statements. Well-led covers leadership, culture, speaking up, workforce inclusion, governance, partnerships, improvement and environmental sustainability.

Within governance, CQC identifies clear responsibility, information about risks and outcomes, record quality, data protection, resilience and regulatory requirements. NHS trusts also have specific Well-led guidance; providers should use the guidance relevant to their organisation.

Draft sector frameworks

CQC published four initial sector-specific drafts in March 2026. The proposals use supporting key lines of enquiry and rating characteristics, remove scoring and make rating judgements directly at key-question level.

Feedback closed in June. CQC scheduled pilots for June to October and evaluation for November 2026; pilot judgements do not alter a provider's regulatory rating. A scheduled evaluation is not a confirmed commencement date. This guide therefore treats the sector material as draft and retains the current approach.

Regulation requires

Well-led is an assessment question, not one single statutory duty. Regulation 17 supplies the core governance requirements. Director suitability, employment checks, staffing, candour and other obligations may also be relevant, depending on the provider and circumstances.

Map a concern to the actual obligation before deciding the required response. A weak management dashboard and unsafe treatment may be linked, but they are different findings with different evidence needs.

Our recommendation: test leadership through decisions

Select a recent safety concern, a complaint and a workforce issue. Follow each through escalation, review, action and outcome. Ask different people to explain the process. Differences between the written procedure and staff experience are useful questions for further review.

Look for evidence that leaders hear uncomfortable information. A large volume of concerns does not by itself establish poor care, and an empty speaking-up register does not prove an open culture. Consider accessibility, trust, response quality and whether people can see what changed.

Review whether management information reveals differences between locations, shifts or groups using the service. An overall average can obscure a persistent problem in one part of the organisation.

Keep assurance proportionate

A small provider needs clear responsibility and effective oversight, but does not need to imitate a hospital trust's committee structure. Use a simple meeting and reporting cycle that addresses the service's actual risks.

Document how leaders know an action is complete. Replacing a policy may be an intermediate step; observation, record review or feedback can help determine whether practice changed. Make room to reopen an action where the evidence is weak.

Other law requires

Information shared for governance remains subject to confidentiality and data-protection duties. Use aggregated or anonymised material where it can answer the question. Restrict access to identifiable records and keep the underlying basis for sharing clear.

Assessment readiness should support safe, lawful care. It should never become a reason to suppress concerns, alter historical records or coach people to give a preferred account.

Evidence checklist

  • Current organisational responsibilities and delegated authority.
  • Governance minutes showing challenge, escalation and decisions.
  • Risk and action registers connected to actual outcomes.
  • Staff feedback and speaking-up arrangements.
  • Patient or service-user feedback with follow-up evidence.
  • Leadership development, suitability and succession arrangements.
  • Framework-labelled evidence map with review dates.

Common questions

Should I reorganise everything around the draft KLOEs?

Use them for horizon scanning and comparison, but retain the current framework until CQC confirms what applies to your service. Keep statutory requirements at the centre of the evidence map.

Does a Well-led review produce a CQC rating?

No. It is an independent review of a defined body of evidence. Only CQC issues its regulatory assessment and rating.
