Three things to put in place.
- Original notice, report, covering email and evidence of service.
- Procedure-specific deadline record with a verified trigger date.
- Numbered issues schedule and evidence index.
First identify what has arrived
Record the document type, the legal person addressed, how and when it was sent or served, the proposed action and every stated deadline. Preserve the original email, attachment and envelope where relevant. A report date is not necessarily the date that starts a procedural time limit.
Assess immediate safety obligations separately. Challenging a factual statement does not remove the need to protect people, comply with operative registration conditions or address an urgent risk.
Factual accuracy of a draft report
Current CQC guidance allows 10 working days from the date of its draft-report email. Points should identify the passage, explain the inaccuracy or omission and attach relevant evidence from the assessment period.
The procedure covers typographical or numerical errors, inaccurate facts affecting judgement, and relevant additional or omitted information. Later remedial work can be explained, but normally does not change the original rating decision. Factual accuracy is not the route for challenging enforcement or simply expressing disagreement with a rating.
Rating process review
CQC's current rating process review must be requested within 15 working days of publication. It permits one request per assessment through its online form, subject to a 500-word limit.
The ground concerns whether CQC followed its process for making the rating decision. It is not a fresh assessment of all the merits. Set out the specific process departure and its relevance, rather than reproducing a general complaint.
Warning Notices and Notices of Proposal
- Warning Notice: written representations within 10 working days of service. The compliance date in the notice is a separate deadline. There is no statutory tribunal appeal against the Warning Notice itself.
- Notice of Proposal: representations generally have a 28-calendar-day period after service. Confirm the service rules and ensure the response and evidence arrive in time.
- Notice of Decision: a tribunal appeal generally has a 28-calendar-day period from service. Verify the particular decision, notice and applicable rule before calculating.
- Urgent action: obtain prompt, procedure-specific advice. Urgent measures can operate immediately; do not assume an appeal suspends them.
Our recommendation: prepare a disciplined response
Use a numbered issues schedule. For each issue, separate accepted facts, disputed facts, the supporting evidence and the requested correction or outcome. Acknowledge genuine shortcomings and explain the action taken without altering or retrospectively rewriting the historical record.
Maintain a separate improvement plan with accountable owners and completion evidence. Keep the challenge focused on its permitted grounds while ensuring operational leaders continue the necessary remedial work.
Legal support and limits
Different procedures require different advice and representation arrangements. The Care Standards Tribunal permits legal and non-legal representatives under its rules; that does not make every form of litigation or advocacy interchangeable.
Before accepting a legal engagement, confirm the contracting person or entity, precise scope, practising arrangements, competence, insurance and complaints route. Information on this page does not create a retainer or calculate a binding deadline.
Evidence checklist
- Original notice, report, covering email and evidence of service.
- Procedure-specific deadline record with a verified trigger date.
- Numbered issues schedule and evidence index.
- Evidence relating to the period assessed, separately from later improvements.
- Immediate safety and compliance actions.
- Approved response and proof of timely submission.
- Documented instructions for any legal representation.
Common questions
Do I have 28 days to challenge every CQC notice?
No. Warning Notice representations use 10 working days from service. Other procedures have different periods and triggers. Check the exact document and source.
Does making an appeal stop urgent action?
Do not assume so. Urgent action can take effect immediately. The particular statutory route and any order must be reviewed promptly.
